My Garden - Plant Care Tracker

1. Acceptance of Terms

By downloading, installing, or using My Garden - Plant Care Tracker ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the App.

These Terms constitute a legally binding agreement between you and Glipo ("we," "our," or "us") regarding your use of the App.

2. App Description

My Garden is a plant care tracking application that helps users:

  • Manage their plant collections
  • Track care activities and schedules
  • Identify plants using AI technology
  • Monitor plant health through AI analysis
  • Set reminders for plant care tasks
  • Access premium features through subscription

The App includes both free and premium features, with premium functionality available through in-app purchases.

3. User Accounts and Data

The App stores your plant data locally on your device. No user account registration is required. Your data is private and is not shared with third parties, except as outlined in our Privacy Policy.

You are responsible for:

  • Maintaining the security of your device
  • Backing up your data as needed
  • Ensuring accurate information input

4. Data Collection and Use

We collect only the minimum data necessary for app functionality, including:

  • Photos you take for identification and analysis

5. AI Services

The App uses third-party AI services (OpenAI and Google Gemini) for plant identification and health analysis. When you use these features:

  • Your photos may be processed by these external services
  • We do not store your photos on external servers
  • AI results are provided for informational purposes only
  • Accuracy is not guaranteed and should not replace professional advice
  • You acknowledge that AI analysis may contain errors

6. Premium Subscriptions

Premium features are available through subscription managed by RevenueCat and processed through your device's app store (Apple App Store or Google Play Store).

Premium Features Include:

  • Unlimited AI plant identification
  • Advanced health analysis
  • Premium themes and customization
  • Export and backup functionality
  • Priority customer support
  • Exclusive content and features

Subscription Terms:

  • Subscriptions auto-renew unless cancelled
  • Cancellation must be done through your app store account
  • Refunds are subject to app store policies
  • Premium features are available only during active subscription
  • Free trial periods may be offered for new subscribers

7. Prohibited Use

You agree not to:

  • Use the App for any illegal or unauthorized purpose
  • Attempt to reverse engineer or modify the App
  • Share or distribute copyrighted content without permission
  • Use the App to harm plants, animals, or the environment
  • Provide false or misleading information
  • Interfere with the App's functionality or security
  • Use automated systems to access the App

8. Intellectual Property

The App and its content are protected by intellectual property laws. We retain all rights to:

  • App design, code, and functionality
  • Trademarks and branding
  • Original content and materials

You retain rights to:

  • Photos and content you create
  • Personal plant data you input

Third-party content (AI services, libraries) remains the property of respective owners.

9. Disclaimers and Limitations

Plant Care Disclaimer:

The App provides general plant care information and AI-powered suggestions. This information is for educational purposes only and should not replace:

  • Professional horticultural advice
  • Veterinary consultation for pet-safe plants
  • Expert guidance for rare or valuable plants

AI Service Disclaimer:

AI plant identification and health analysis are provided "as is" without warranties of accuracy, completeness, or reliability.

No Warranties:

The App is provided without warranties of any kind, express or implied, including but not limited to merchantability, fitness for a particular purpose, or non-infringement.

10. Liability Limitations

To the maximum extent permitted by law, Glipo shall not be liable for:

  • Plant damage or loss resulting from App use
  • Inaccurate AI identification or health analysis
  • Data loss or device damage
  • Indirect, incidental, or consequential damages
  • Loss of profits, data, or business opportunities

Our total liability shall not exceed the amount you paid for premium features in the 12 months preceding the claim.

11. Termination

You may stop using the App at any time. We may terminate or suspend your access if you violate these Terms.

Upon termination:

  • Your right to use the App ceases immediately
  • Local data remains on your device
  • Premium subscriptions continue according to app store terms
  • These Terms survive termination where applicable

12. Changes to Terms

We may update these Terms periodically. Significant changes will be communicated through:

  • In-app notifications
  • Email (if provided)
  • App store update notes

Continued use after changes constitutes acceptance of new Terms.
